Skier Sues Sunshine Village, Snowboarder Following Collision

Edmonton (AB), Canada – An Edmonton man has filed a lawsuit against Sunshine Village ski area in Banff and the snowboarder who collided with him.nGeorge Schuller claims that he was skiing the Picadilly Circus run near the White Way trail intersection at Sunshine Village on Feb. 28, 2009, when snowboarder Rachel Holub entered the trail from its edge and collided with his left leg. He claims permanent disability due to a laceration to his left leg that required surgical repair, and that he has since undergone extensive physiotherapy, orthopedic consultations and home exercise.

Schuller alleges that Holub failed to maintain a proper lookout and to snowboard at a safe speed. He further alleges that Sunshine Village was negligent for not properly marking the trail intersection and to erect barriers to keep patrons on designated trails. He is seeking CAN$275,000 in his lawsuit.

Neither defendant has yet to file a Statement of Defence, analagous to an Answer filed in an American lawsuit.
